Permitted use of the Learning Management System
This Learning Management System (LMS) has been conceived and designed by and at the cost of Derma Aesthetics Australia Pty Limited (DA) in order to provide educational resources and support for skin treatment specialists (and those intending to become skin treatment specialists) - whether such persons are employed within a specialist skin clinic (Clinic) or working as independent contractor, or in any other capacity (each, a User).
The LMS also contains resources in connection with the performance of various skin treatments (Treatments) using devices and consumables supplied by DA (collectively, the Devices) and/or in connection with products supplied by DA (each, a Product).
The LMS should only be used for this purpose.
Intellectual property rights
DA owns all registered and unregistered intellectual property rights in and to the LMS – including:
- all copyright relating to content of the LMS;
- all design rights relating to the layout, design and functionality of the LMS; including all written literature and additional resources.
- all trademarks including the domain name and all business names used in the LMS (unless owned by the manufacturer of a Device or Product).
The LMS must not be used or copied or reproduced in whole or in part for any other use without the prior written consent of DA.
Permission to use materials
Authority to use the LMS is at the discretion of DA and DA may suspend, revoke or restrict as User’s access to the LMS, or impose conditions in relation to the use of LMS, at any time.
DA reserves the right to impose a charge for access to some areas of the LMS.
Release
While DA has taken care to develop and maintain the LMS, DA accepts no responsibility or liability in relation to the accuracy or completeness of the information contained on the LMS, or for any errors of omissions from the LMS.
All Users of the LMS do so at their own risk and to the maximum extent permitted by law, Users unconditionally and irrevocably release DA of all and any claims arising from the use of the LMS of any kind.
If a User discovers any error on the LMS then they should contact DA by phone or email as shown below.
Information of a general nature only
All information contained on the LMS is very general in nature and cannot deal with every allergy and skin condition and every skin type in existence.
Users of the LMS need to exercise due care and skill when using any information from the LMS for any particular patient. In particular, Users must take into account whether their clients have particular skin conditions or allergies, whether they are on skin related or other medications, whether they have implants/ cosmetic fillers etc and/or whether any other special circumstances apply to a client, before providing any advice to a client based in whole or in part on the information contained in this LMS.
If any clients have these or any other conditions, then Users should also recommend to their clients that they should consult with their health care professional before taking any treatment or using any products or services on offer.
To the maximum extent permitted by law, all Users unconditionally and irrevocably release DA of all and any claims arising from the use or application of all or any the information contained on the LMS (including any adverse reaction and/or accidental injury or death).
Connection with DA
Users of the LMS are not permitted to advertise or market that they are Users of the LMS or that they have any affiliation with DA, except with the prior written consent of DA.
Without limitation Users must not advertise that they have “accreditation” or “certification” from DA and/or any “licence” to operate as an affiliate of DA.
Access to Website
Users are given access to the LMS for their own use and must not allow any other persons to use the LMS under any circumstances. Users must securely store their access/login password to the LMS and not divulge such details to any other persons.
Changes to the Website
DA may modify the LMS at its discretion, without notice to the User.
DA may modify these terms and conditions) at its discretion. In such event that any such change is made you will be asked to review and accept these modified terms as a condition of access to the LMS.
Breach
DA may in its absolute discretion suspend, revoke or restrict a User’s access to the LMS if DA believes that the User is not complying with any of the above mentioned conditions. No advance notice must be given and no reasons need to be given before any such action is taken by DA.
If any User breaches any of these terms and conditions (for example, a breach of copyright or unauthorised use of any business name or other trademark) and DA directly or indirectly suffers any loss or damage as a result of such breach, then the User unconditionally and irrevocably indemnifies DA, and shall keep DA so indemnified, for and in respect of all such loss and damage, however suffered.
Collection, storage and use of personal information
Personal Information (as defined in the Privacy Act 1988 (Australia) and the Privacy Act 1993 (New Zealand) is collected, stored and used by DA in accordance with the Privacy Principles (as defined in both the above Acts).
In connection with the LMS, Personal Information may be collected to maintain contact with or market products and services to Users, to notify Users of changes to the LMS or new feature on the LMS from time to time, to investigate and improve the functionality of the LMS, to investigate the frequency of the use of particular Modules on the LMS and improve resources on the LMS, and other purposes. It is not provided to third parties.
